1. Acceptance of Terms
By accessing and using the website and services at clearyourtrademark.com (the "Service"), operated by us, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service.
2. Description of Service
The Service provides an AI-powered tool to search for visually similar trademarks. It uses a Vision Transformer model to analyze uploaded images and generate similarity reports.
IMPORTANT: THE SERVICE PROVIDES INFORMATIONAL, PRELIMINARY SIMILARITY ANALYSIS ONLY. IT IS NOT
LEGAL ADVICE, A TRADEMARK CLEARANCE SERVICE, OR A GUARANTEE OF TRADEMARK AVAILABILITY OR REGISTRABILITY. YOU SHOULD
CONSULT A QUALIFIED TRADEMARK ATTORNEY FOR LEGAL ADVICE BEFORE MAKING ANY BUSINESS OR LEGAL DECISIONS.
3. Subscriptions, Free Trial, and Billing
- STANDARD Plan: The Service is offered as a subscription plan ("STANDARD Plan") at $10 (USD) per month. It includes 50 image searches per month, priority processing, access to saved searches, advanced search filters, and email support for one (1) user.
- 7-Day Free Trial: We offer a one-time, 7-day free trial for new users, which includes 15 image searches. To start the trial, you must provide a valid payment method. YOU WILL NOT BE CHARGED DURING THE TRIAL PERIOD.
- Conversion to Paid Subscription: At the end of the 7-day trial period, your subscription will automatically convert to the paid STANDARD Plan at $10/month. Your payment method will be charged unless you cancel before the trial ends.
- Billing and Cancellation: Subscriptions renew monthly. You may cancel anytime via your account settings to stop future charges. CANCELLATION MUST BE COMPLETED PRIOR TO THE END OF YOUR FREE TRIAL OR BILLING CYCLE TO AVOID THE NEXT CHARGE. Fees for paid months are non-refundable.
- Account Profile: View your current plan status, trial period, and credit usage on your profile page. To avoid future charges, cancel via account settings before the end of your free trial or billing period.
- Account Security: You are responsible for maintaining the confidentiality of your account.
4. Intellectual Property Rights
- Our IP: We own all rights, title, and interest in the Service, including our AI model, website, and underlying technology.
- Your Uploads: You retain ownership of the trademark images you upload. By uploading, you grant us a limited, non-exclusive license to process the image through our AI system solely to provide the Service to you.
- Generated Reports: The AI-generated similarity reports created for you are your property. However, they are provided "AS IS" without any warranty of accuracy or fitness for a particular purpose.
- Third-Party Trademarks: All trademarks found in search results are the property of their respective owners. Our Service merely identifies potential visual similarities.
5. Acceptable Use and Prohibitions
You agree not to use the Service to:
- Infringe on the intellectual property rights of others.
- Reverse engineer, decompile, or attempt to extract the source code of our AI models.
- Use the Service for any illegal purpose or to generate misleading legal conclusions.
- Exceed the monthly image search limit by creating multiple accounts to circumvent restrictions.
6. Limitation of Liability and Disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND.
- WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOST PROFITS OR LEGAL FEES) ARISING FROM YOUR USE OF THE SERVICE OR RELIANCE ON ANY REPORT.
- OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THESE TERMS OR THE SERVICE IS LIMITED TO THE AMOUNT YOU HAVE PAID US IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY.
7. Governing Law
These Terms shall be governed by the laws of the State of Delaware, without regard to its conflict of law principles.
